Influencer Disclosure Rules in India: What Brands Must Know

Disclosure is the part of influencer marketing brands skip, and the part that has consequences. In India the responsibility does not sit only with the creator.

The Principle

If there is a material connection between the brand and the creator, the audience must be told, clearly, before they engage with the content. That connection is not only cash. It includes free product, free service, discounts, travel, gifts and affiliate commission.

If the creator got something they would not otherwise have had, it needs disclosing. Gifted is not a loophole.

What Good Disclosure Looks Like

Why It Is the Brand's Problem

Brands often assume disclosure is the creator's job. In practice it is the brand's name on the post, the brand that instructed the campaign, and the brand that carries reputational and regulatory exposure when a campaign is found to be undisclosed advertising.

The practical answer is simple: put the disclosure requirement in the brief, in writing, and check the post when it goes live. A missing label is fixable in the first hour and awkward a week later.

The Other Half: Claims

Disclosure is only one part. What the creator says is regulated too. A creator cannot make a claim on your behalf that you could not legally make yourself — especially around health, treatment outcomes, finance and anything aimed at children.

This is why the 'never say' section of your brief matters more than the creative direction.
